Lesson 10 of 10-lesson course: Politicians Must be Part of the Solution if We Are to Win China’s Silent War on America

Lesson 9 explained the greatest roadblock to preventing China from infiltrating America are the politicians. Lesson 10 will not disagree with Lesson 9 on that point, but it will show the reader all is not hopeless. Lesson 10 will provide examples of some of the politicians who have been attempting to pass bills to counter China’s malicious intent and on occasion have been successful.

Further the 2024 Republican Party Platform released on July 8, 2024 indicates the Republican Party understands we must avert World War III by returning to a “peace through thru strength” policy as well as putting “America first” policies in place. Both of these goals will require America take an aggressive and decisive stance on China’s United Front work in America.

2024 Federal Legislation Countering China’s Silent War on America

Below are three proposed federal bills as well as one newly passed law, which attempt to push back against China’s United Front Work in America. These bills remove manufacturing subsidies which would discourage China from doing business here in America, identify and block United Front Work that is occurring in America, punish those involved in China’s Drug on America and prevent American citizens biometric data from being used against them.

1. Protecting American Advanced Manufacturing Act

Senate bill S.3486 is sponsored by Senator Marco Rubio, while H.R.6762, the companion bill in the House of Representatives, is sponsored by Representative Carol Miller.

The Protecting American Advanced Manufacturing Act prohibits companies associated with governments of foreign adversaries, like China, from receiving the advanced manufacturing production tax credit.

The advanced manufacturing production tax credit mentioned above is the source of the potentially $350 million dollars that may be given to Illuminate USA, the solar panel assembly plant located in Pataskala, Ohio, which is 49%-owned by LONGI a CCP-linked corporation. If these tax credits dry up, there is an almost 100% certainty this CCP-connected factory would need to pack up and go back to China.

2. Countering China’s Political Warfare Act

The Senate Bill is S. 3973 and is sponsored by Senator Tom Cotton. The companion bill in the House is House Bill 7646 and is sponsored by Representative Jim Banks.

The Countering China’s Political Warfare Act would sanction any individual or group that conducts political warfare on behalf of a foreign government against the United States. The legislation also requires the Secretary of State to determine if the United Front Work Department (UFWD)—an overseas influence arm of the Chinese Communist Party—qualifies for sanctions.

3. Fend Off Fentanyl Act-Signed Into Law

The Fend Off Fentanyl Act passed on April 24, 2024 allows government agencies to disrupt the opioid supply chain more effectively, from the chemical suppliers in China to the cartels that traffic the drugs from Mexico. Further, the legislation specifically declares international fentanyl trafficking a national emergency and ensures sanctions on the illicit drug trade as well as the money laundering that makes it profitable.

4. BioSecure Act to Keep American Data Safe

The BioSecure Act is part of Speaker Johnson’s bigger package targeting the end of 2024 for Congress to pass a “significant” package of legislation aimed at curbing China. The goal of BioSecure Act is to prohibit US tax payer dollars from flowing to foreign adversary-controlled biotech companies engaging in nefarious activities.

2024 State of Ohio Legislation Countering China’s Silent War on America

Below is information on the bills in the Ohio General Assembly that are attempting to restrict China from owning property in Ohio. They are called the Ohio Property Protection Act.

Ohio Senate Bill S 226 was sponsored by Senator Terry Johnson.

Ohio House Bill HB 212, the companion bill in the Ohio House of Representatives, was sponsored by Representative Roy Klopfenstein and Representative Angela N. King.

The Ohio Property Protection Act restricts foreign adversaries and certain businesses from owning real property in Ohio. It is making its way through the legislative process in the two chambers of the Ohio General Assembly. The bill would allow adversarial nations, like China, to only own up to 49% of the real property or business in which it is involved. This level of ownership is similar to bills passed in other states.

While this is less than ideal, it is still better than no restrictions. It does, however, imply a clear intent by Illuminate USA in Pataskala to anticipate this situation when setting up its business structure. Invenergy, the Chicago-based American corporation, owns 51% and the Chinese corporation, LONGI, owns 49% of Illuminate USA. So if this bill passed with its current language, Illuminate USA would continue with business as usual.

On June 26, 2024, the Ohio Senate did pass its version of the bill, Senate Bill 226.

Unfortunately 2024 has not been a good year for the State of Ohio’s House of Representatives due to a controversy over the current House speaker, Jason Stephens. Consequently, like most legislation in the House, House Bill 212, the companion bill to Senate Bill 226, is bogged down in the House-in spite of the fact that HB 212 has 37 co-sponsors, which shows a significant amount of support.

Ultimately this may be a good thing. With new leadership in both Ohio chambers in 2025, and given the abundant number of co-sponsors in the House supporting the bill and the fact the Senate did pass the bill, passage of this bill in 2025 is a reasonable expectation. Further, perhaps the percentage of property adversarial nations could own could be reduced-especially if the citizens use their voices to promote that narrative.

Even though the Ohio Property Protection Act has not passed this year, many of our legislators in the Ohio General Assembly did the right thing by sponsoring or co-sponsoring this bill. We want them to know we appreciate what they did and expect both of the Ohio Chambers in 2025 to reintroduce a similar bill-but this time to reduce the percent of US property an adversarial nation can own to a percent significantly below 50%.

I believe the passage of this bill through the House in 2024 is unlikely. This provides an opportunity in 2025 for the legislators to re-introduce a similar version in the Ohio General Assembly. However, it is critical that the new legislation reduce the percent of US property an adversarial nation can own to a percent significantly below 49%.

Otherwise, factories like Illuminate USA in Pataskala, Ohio, which is 49% owned by LONGI, a Chinese corporation, will maintain its eligibility to receive up to $350 million dollars per year from the federal Inflation Reduction Act (IRA) and to continue to employ a significant number of Chinese nationals, whose presence poses a national security risk. The IRA funds were intended for American companies and the jobs held by the Chinese nationals were intended for American workers.
